Republican lawmakers in three swing states have filed legislation intended to keep President Joe Biden off their 2024 ballots, setting up a showdown that’s certain to pit the president’s legal team against opponents riled up in the wake of a similar move by the Colorado state Supreme Court to deny ballot access to former President Donald Trump.
Breitbart scooped the moves by Rep. Aaron Bernstine of Pennsylvania, Rep. Charlice Byrd of Georgia, and Rep. Cory Mcgarr of Arizona to legislate the Democratic incumbent out of next year’s contest in an attempt to fight the “lawfare” they claim is being used against Trump. Colorado’s highest court ruled earlier this week that President Trump engaged in “insurrection” surrounding the January 6th 2021 riots at the Capitol and is ineligible for the presidency under the 14th Amendment of the Constitution.
“We are joining forces to introduce legislation to REMOVE Joe Biden from the ballot in Georgia, Arizona, and Pennsylvania,” the lawmakers told Breitbart News. “The absurdity of radical Democrat judges removing Donald Trump from the ballot in Colorado will be a stain on the American political system for decades. By their very own interpretation of the law, Joe Biden is 100% not eligible to run for political office.”
“Democrats’ insane justification to remove Trump can just as easily be applied to Joe Biden for his ‘insurrection’ at the southern border and his alleged corrupt family business dealings with China,” they continued.
“Colorado radicals just changed the game and we are not going to sit quietly while they destroy our Republic. To be clear, our objective is to showcase the absurdity of Colorado’s decision and allow ALL candidates to be on the ballot in all states,” they wrote. “To do that, we must fight back as Republicans against the communists currently running our great country.”
The attempt to keep Biden off the ballot mirrors a threat by Texas Lt. Governor Dan Patrick who told Fox News host Laura Ingraham that President Biden is guilty of insurrection for allowing the country’s migrant crisis at the southern border to spiral out of control. Immigration officials have reported record-setting numbers of illegal crossings across Texas and Arizona where lawmakers have utilized buses and airplanes to transport new arrivals to sanctuary cities like Chicago and New York.
President Biden has accused his Republican rival of engaging in insurrection, though the official line from the White House has been mum in the wake of the Colorado ruling. President Trump’s legal team has already vowed to appeal the decision to the U.S. Supreme Court where another ruling is expected on the 45th president’s claim that he is immune from prosecution in multiple federal cases brought by Biden Justice Department special counsel Jack Smith.
President Trump, reacting to the news on Truth Social, accused his “crooked” rival of much the same.
“Crooked Joe Biden is the Insurrectionist because he let millions of unknown people come recklessly and unchecked through our insane “Open” Border, let a war begin in the Middle East and Ukraine, Weaponized our DOJ & FBI, SURRENDERED in Afghanistan when we could have left with dignity and strength – the most embarrassing event in the history of our Country, and is destroying America with the GREEN NEW SCAM!!!” Trump wrote Thursday.
Pennsylvania, Georgia, and Arizona, all states won by Biden in 2020, now trend toward President Trump who leads the incumbent in polling across most swing states outside the margins of error.
